1. General Information

1.1 Definition of Terms

1.1.1. The operator of the online service is ATHMOsphere s.r.o., Bratislava – Old Town, Panenská 12, ZIP code 81103, IČO: 53497813, DIČ: 2121407640, VAT ID: SK2121407640, according to §4, registered from 15.1.2024, Commercial Register of the Bratislava III District Court, section Sro/15226/B, phone number: 0911634813, email: [email protected] (hereinafter referred to as “ATHMOsphere s.r.o.”) on the website www.athmosphere.sk (hereinafter referred to as “Website”).

1.1.2. The General Terms and Conditions (hereinafter referred to as “GTC”) establish the conditions for using the service (hereinafter referred to as “Service”) provided by ATHMOsphere s.r.o., governing the legal relationship between ATHMOsphere s.r.o. and the final consumer.

1.1.3. The service provided under these GTC is the presentation of selected products of ATHMOsphere s.r.o. (hereinafter referred to as “Product”) on the website with the possibility of ordering (hereinafter referred to as “Order”), preparing them for pickup (hereinafter referred to as “Preparation”) at the company’s address (hereinafter referred to as “Store”) or delivering the Order to the selected address (hereinafter referred to as “Delivery Address”) within Slovakia or abroad (hereinafter referred to as “Delivery Area”).

1.1.4. Delivery of the Order means the use of available delivery methods through delivery companies operating on the Slovak market.

1.1.5. The final consumer (hereinafter referred to as “Customer”) is a natural person, a natural person entrepreneur, or a legal entity who has expressed their consent with these GTC.

1.1.6. The service is exclusively available on working days from 08:00 to 18:00, when the provider ensures services according to these GTC. The functionality of the website is available to the Customer 24 hours a day, without time limits.

2. Service

2.1 Conclusion of the Contract

2.1.1. Within the Service, the purchase contract between ATHMOsphere s.r.o. as the seller and the Customer as the buyer is concluded at the moment of delivery of the Customer’s binding consent to the Order with confirmation of the obligation to subsequently pay the purchase price.

2.1.2. ATHMOsphere s.r.o. reserves the right to refuse the execution of ordered products in unusual circumstances (excessive quantity of Products, large number of Orders from one Customer).

2.1.3. The presented Products are not a binding offer for purchase in accordance with the legal order of the Slovak Republic.

2.1.4. An Order can be made by both registered and non-registered Customers.

3. Provision of the Service

3.1 Order without Registration

3.1.1. The order of Goods can also be placed without registration by filling out the order form published on the website and clicking on the consent with the GTC.

3.2 Order with Registration

3.2.1. The Service allows the Customer to create a customer account (hereinafter referred to as “Account”), through which they can use additional features: Favorites, Shopping Lists, Purchase History. Registered Customers can also receive special discounts available only to registered Customers. The Customer agrees to provide all required information truthfully and completely during registration and confirm that they have read and agree with these GTC. ATHMOsphere s.r.o. handles the provided data in accordance with the law on the protection of personal data.

3.2.2. The Customer may cancel the Account for any reason by sending a request to the contact email address: [email protected].

3.2.3. ATHMOsphere s.r.o. reserves the right to cancel the Customer’s Account at any time without prior notice and without providing a reason if there is suspicion that the Customer is violating the GTC, legal regulations, or damaging the good name of ATHMOsphere s.r.o..

3.2.4. The Account automatically terminates upon the Customer’s death or upon termination of the Service by ATHMOsphere s.r.o..

3.3 Order

3.3.1. Through the Service, it is possible to add Products to the Cart and confirm the Order, select the method of delivery and payment method. During the ordering process, the Customer fills in contact details (if they are not registered and logged in) and confirms the content of the Cart.

3.3.2. The availability of Products is tied to the current stock, and ATHMOsphere s.r.o. does not guarantee it. The images of Products are for illustrative purposes only.

3.3.3. Upon receipt of the Order, the system will send an automatic email to the Customer’s email address confirming the receipt of the Order, the ordered Products, and the assigned unique Order number.

3.4 Pickup

3.4.1. The delivery of goods is exclusively carried out through external delivery under the conditions stated in point 3.5 of these GTC.

3.5 Delivery

3.5.1. After packing the Products for Delivery, the Service will send an automatic email to the Customer’s email address notifying that the packed order has been handed over to the carrier. The email will also include the Order number, which the Customer must provide to the carrier upon receipt of the Goods. Without the Order number, the Products will not be handed over to the Customer.

3.5.2. Product preparation for dispatch is possible during the Service provision period. If the Customer places the order outside of this time, the earliest interval for preparing the Products for dispatch will be the next working day.

3.5.3. ATHMOsphere s.r.o. is not responsible for delays in Delivery caused by force majeure or unforeseen events (accidents, road accidents, vehicle breakdowns).

3.5.4. If the Customer does not pick up the delivered Products at the Delivery Address, ATHMOsphere s.r.o. has the right to cancel the order and not deliver the Products. Such actions by the Customer are considered a violation of the GTC by ATHMOsphere s.r.o. If the Customer is registered, ATHMOsphere s.r.o. may cancel their registration. If the Customer has already paid for the delivery of the Products, they are not entitled to a refund of the already paid purchase price, which will be considered a contractual penalty for violating the GTC.

3.6 Price

3.6.1. The price of each Product on the website is stated in EUR, including the applicable value-added tax.

3.6.2. Delivery of Products is charged according to the currently valid price list of the respective delivery company. If the selection of the delivery company is up to ATHMOsphere s.r.o., they will choose the most efficient delivery method for the Customer.

3.7 Payment Terms

3.7.1. The payment for the purchase is made A) online via a payment gateway… – after packing the order, the Customer will receive an email with a link to complete the payment B) on cash on delivery – payment upon receipt of the Product.

3.7.2. In case of a transaction rejection during payment for the Products, ATHMOsphere s.r.o. is entitled to refuse to hand over the Product.

3.7.3. ATHMOsphere s.r.o. reserves the right not to accept other payment methods for the delivered goods other than those mentioned above.

3.8 Withdrawal from the Contract

3.8.1. The Customer has the right to withdraw from the purchase contract without giving a reason within 14 days from the receipt of the goods purchased through this website. To comply with the deadline, it is sufficient if the Customer sends a withdrawal request using the appropriate form to the email address: [email protected].

3.8.2. In case of withdrawal from the purchase contract before the delivery of the Product after paying the purchase price, the purchase price will be refunded to the Customer within 14 days from receiving the electronic acknowledgment of withdrawal from the purchase contract. In case of withdrawal after the delivery and payment for the Product, the purchase price will be refunded to the Customer within 14 days of receiving the returned goods.

4. Rights and Obligations of the Parties

4.1 Rights and Obligations of ATHMOsphere s.r.o.

4.1.1. ATHMOsphere s.r.o. is responsible for providing the Service in accordance with these GTC and applicable laws.

4.1.2. ATHMOsphere s.r.o. is obliged to deliver the Products ordered by the Customer in accordance with the agreed conditions and ensure the correct packaging and proper delivery of the ordered Products.

4.1.3. ATHMOsphere s.r.o. is entitled to reject or cancel any Order if the Customer violates these GTC or if the order seems suspicious.

4.1.4. ATHMOsphere s.r.o. reserves the right to refuse a transaction if the Product is no longer available, and will notify the Customer about it without undue delay.

4.1.5. ATHMOsphere s.r.o. ensures that the Goods meet the quality standards required by law.

4.2 Rights and Obligations of the Customer

4.2.1. The Customer is obliged to provide accurate and complete contact and delivery information during the registration or ordering process.

4.2.2. The Customer is obliged to check the ordered Products immediately after their receipt and report any defects or discrepancies to ATHMOsphere s.r.o. within 24 hours of receiving the Product.

4.2.3. The Customer is responsible for complying with all applicable laws and regulations when using the Service, including but not limited to regulations concerning the payment of taxes and duties.

4.2.4. The Customer agrees not to use the Service for any illegal or unauthorized purposes and agrees to comply with all local laws regarding online conduct and acceptable content.

5. Product Warranty and Returns

5.1 Warranty

5.1.1. The Products purchased from the online store come with a statutory warranty for defects. If the Customer receives a defective Product, they are entitled to claim a warranty and request a replacement, repair, or refund, in accordance with the applicable consumer protection laws.

5.1.2. In case of a warranty claim, the Customer must submit proof of purchase and a description of the defect to ATHMOsphere s.r.o. ATHMOsphere s.r.o. will assess the claim and decide whether to accept or reject it.

5.2 Return of Goods

5.2.1. The Customer is entitled to return the Goods within 14 days from receiving them, as long as the Goods are unused and in their original packaging.

5.2.2. To return the Goods, the Customer must complete the return form provided by ATHMOsphere s.r.o. and send it together with the Goods to the specified return address.

5.2.3. The return shipping costs are borne by the Customer, except when the return is due to a defect or incorrect delivery of the Product.

5.2.4. If the returned Goods meet the conditions, ATHMOsphere s.r.o. will refund the purchase price within 14 days from receiving the returned items.

6. Privacy and Data Protection

6.1 Data Protection

6.1.1. ATHMOsphere s.r.o. respects the privacy of its Customers and is committed to protecting the personal data provided during the use of the Service.

6.1.2. The personal data collected from the Customer will be processed in accordance with the applicable data protection regulations, including the General Data Protection Regulation (GDPR). 7.1.2. ATHMOsphere s.r.o. is not liable for any delays in delivery caused by external circumstances, including but not limited to force majeure, natural disasters, or third-party delivery service issues.

7.1.3. In case of a failure or defect of the Website, ATHMOsphere s.r.o. will make efforts to promptly restore its functionality. However, ATHMOsphere s.r.o. is not liable for any temporary unavailability of the Website.

8. Final Provisions

8.1 Changes to the GTC

8.1.1. ATHMOsphere s.r.o. reserves the right to amend or update these GTC at any time. The changes will be communicated to the Customer via the Website, and the new version of the GTC will be effective from the moment it is published.

8.1.2. The Customer is bound by the version of the GTC that is in effect at the time of placing the Order, unless the Customer has expressly agreed to the changes.

8.2 Governing Law and Dispute Resolution

8.2.1. The contractual relationship between ATHMOsphere s.r.o. and the Customer is governed by the laws of the Slovak Republic.

8.2.2. In case of disputes, the parties will seek to resolve them amicably. If an amicable resolution is not possible, the dispute will be resolved by the competent courts of the Slovak Republic.
